Flexible Levels of Categorical Exemptions under the
State Environmental Policy Act of 1971
The State Environmental Policy Act (SEPA) specifies that certain activities, or “actions,” must be reviewed for their potential impact on the human and physical environment. Other activities fall within “categorical exemptions” and do not need to be analyzed under the procedural requirements of SEPA. Within the category of Minor New Construction (WAC 197-11-800(1)) the Act allows cities and counties latitude to establish what are termed “flexible” thresholds for certain activities.
Douglas County is considering the adoption of new thresholds for some of the options allowed under SEPA. These new “flexible” thresholds may apply countywide in unincorporated areas or just within certain areas.
